General Terms
Grouprides are training rides, not races. Each participant is responsible for bringing their own sport-appropriate bicycle (e.g., road bike) and any necessary clothing and equipment (helmets, shoes, rain gear, etc.). Only natural persons aged 18 and above (proof of age may be requested) who are physically capable of cycling are eligible to participate. Grouprides acts as an intermediary for events and is not the organizer. The rides are organized and run by the individual or company named on the event details page.
By using grouprides.cc and registering for an event posted by an organizer on grouprides.cc, you as a participant agree to the following terms of use.
By participating in a Groupride, you explicitly confirm that:
There are no health issues preventing you from participating (each participant is responsible for assessing their own health status – the organizer assumes no liability for participants’ health risks in connection with the event);
You will observe and comply with traffic regulations (including local laws) during the ride;
You acknowledge the authority of any appointed guide and will follow their instructions;
You will use a roadworthy bike (e.g., road, gravel, or mountain bike) and wear a certified (CE) helmet;
Photos and videos may be taken and published as part of the event. If you do not wish to be included, please inform the organizer on-site;
You consent to the free use and publication of photos and videos of you taken during the event (e.g., on social media). By participating, you give automatic consent for these purposes without needing further explicit approval;
Grouprides or third parties (e.g., organizers and partners) may contact you via email at the address provided;
You participate voluntarily, at your own risk, and on your own responsibility;
You waive the right to challenge your exclusion from the event, or from future events, due to unsportsmanlike or dangerous behavior, and will not pursue legal action regarding such exclusion;
Neither the organizer nor Grouprides are liable for damages related to the event, except for damages caused by intentional or grossly negligent breaches of duty. Risks include, but are not limited to: collisions with pedestrians, vehicles, other riders, or fixed/moving objects; road conditions; equipment failures; weather; insufficient safety gear; and other hazards.
You understand that risks may arise from your own actions, those of other participants, or the environment (such as terrain and weather conditions), or from non-participants in the event;
Grouprides, being neither the organizer nor involved in the event, is not liable for anything that occurs during or in connection with the event.
Liability and Insurance
- Grouprides ensures that the platform meets recognized technical standards and is free from defects that would impair its use or value for the ordinary or contractually expected purposes.
- As Grouprides is not involved in organizing the events, it is not liable for anything that occurs during or in connection with the rides.
- Grouprides’ liability for defects in free services is limited to cases of fraudulent concealment. Users of free services have no claims for rectification of defects. Liability for legal defects in free services is also limited to cases of fraudulent concealment.
- Participants are responsible for reporting defects or damages that could disrupt the service or its safety. Users should take all reasonable steps to assist in identifying defects or damages and their causes or to facilitate or expedite their rectification.
- Grouprides is obliged to promptly rectify defects in paid content. The warranty is governed by the statutory provisions on rental agreements (§§ 535 ff BGB). § 536a para. 1, 1st alternative BGB (which provides for strict liability for damages) is excluded.
- Grouprides is not liable for any claims arising from temporary unavailability of services due to maintenance work, unless such unavailability exceeds 1.0% of a year per calendar year, and no gross negligence or intent is involved in longer outages.
- Grouprides assumes no liability for participants’ health risks related to their participation in events.
- Grouprides is fully liable for damages caused by intentional or grossly negligent acts, fraudulent concealment of defects, claims under the Product Liability Act, and for injury to life, body, or health.
- For other damages, Grouprides is only liable where a breach of duty essential to the contract’s proper performance occurs (cardinal obligations).
- These liability limitations apply to Grouprides’ agents as well.
- Participants are fully responsible for their actions and liable according to legal provisions. You must comply with all applicable rules, especially the obligation to respect other road users during the event.
- Organizers are not liable for damages resulting from the inherent risks of cycling, particularly for those caused by participants’ independent actions. Organizers are not liable for third-party actions that cause harm to participants.
- For property damage, liability is limited to intentional or grossly negligent acts. Liability for simple negligence is excluded unless it involves injury to life, body, or health due to negligent acts by the organizer or their legal representatives.
- Participants must ensure their own insurance coverage for accidents, illnesses, or other risks during the event. If fees are charged by the organizer, they do not include any insurance.
- In the event of an accident for which the organizer is not liable under these terms, participants must cover any damages, fees, or costs incurred. This may include, but is not limited to, the costs of emergency services, fire departments, or mountain rescue operations.
- Participants acknowledge that instructions and routes during the event may differ from the originally communicated plans due to unforeseen circumstances, such as changes in traffic management.
- If accessing the website on behalf of an organization, you confirm that you are authorized to bind the organization to these terms. Otherwise, you may not access or use the website. These terms include disclaimers and limitations of liability that may apply to you.
- Grouprides’ services and the contract outlined in these terms cannot be fulfilled without processing data about you and other users, including location data. This processing is essential for the services we provide.
- Grouprides is released from liability in cases of force majeure. Force majeure includes unforeseen events and those not attributable to any party, such as pandemics, strikes, or government actions.
Dispute Resolution Notice
These terms include provisions on how legal disputes between you and Grouprides.cc are resolved, including a waiver of personal claims if you do not reside in the European Union.
